2001 December 4 Ordinance - An Ordinance to Establish Regulations for Land Divisions in the Town of Hortonia

Purpose: To regulate and control the division and subdivision of land within the Town of Hortonia, Outagamie County, Wisconsin, to promote the public health, safety and general welfare; to further the orderly layout and use of land; to lessen congestion in the streets and highways; to provide for adequate light and air; to facilitate adequate provision for water, sewage and other public requirements; to provide for proper ingress and egress; to promote proper monumenting of divided land and conveyancing by accurate legal description; and to facilitate the further division of larger tracts into smaller parcels of land.

Abrogation and Greater Restrictions: It is not intended by this Ordinance to repeal, abrogate, annul, impair or interfere with any existing easements, covenants, deed restrictions, agreements, ordinances, rules, regulations or permits previously adopted or issued pursuant to law. However, whenever this Ordinance imposes greater restrictions, the provisions of this Ordinance shall govern.

Compliance: No person, firm or corporation shall divide land which results in a land division, subdivision or replat without compliance with this Ordinance, the Outagamie County Subdivision Ordinance, Chapter 236 of the Wisconsin Statutes, Town and County Development Plans or the Official Map of the Town of Hortonia.

Penalties: Any person, firm or corporation that fails to comply with the provisions of this Ordinance shall upon conviction thereof, forfeit not less than $100.00 and not more than $1,000 and the cost of prosecution for each violation. Each day that a violation exists or continues shall constitute a separate offense.

Fees: Review fees for Certified Survey Maps and Subdivision Plats where no public road will be dedicated are ($100.00) plus Ten Dollars ($10.00) per lot. Review fees where a public road will be dedicated are Two Hundred Dollars ($200.00) plus Ten Dollars ($10.00) per lot. Review fees shall be submitted at the time of submittal.

• this Ordinance adopted December 4, 2001 is the active ordinance

• minutes of the February 5, 2002 meeting indicate, “The County has approved Hortonia’s Land Division Ordinance. It will be effective upon publication.”

• anyone who has a copy of this ordinance with hand written notations must be advised that these notations are NOT adopted – these notations represent edits incorporated into the 2007 draft revision of the ordinance

• September 11, 2007 minutes reflect that “Atty. Carlson gave the board an ordinance establishing regulations for land divisions in the Town of Hortonia”

• a record search through subsequent minutes does not reveal that this 2007 land division ordinance was ever adopted

• the 2001 ordinance section on drainage lacks the comprehensive attention given by the 2007 draft
