2004 November 9 Ordinance - Access Ordinance, Town of Hortonia, Outagamie County, Wisconsin

Purpose: To provide for the safe and efficient ingress and egress to certain Town Roads; to protect the public investment in roads by preventing premature functional obsolescence; to reduce accidents caused by frequent and poorly designed points of access; to promote the balanced use of land for the mutual protection of landowners, motorists, and the Town of Hortonia; and to enhance road appearance.

Spacing: No access point shall be granted within 250 feet of an adjacent intersecting County or primary Town highway unless restricted by topography or other factors. No access point shall be granted within 500 feet of an adjacent intersecting federal or state highway unless restricted by topography or other factors.

Driveway Access: Driveways shall be at right angles or approximately right angles to the road pavement except as topography may make angular placement necessary. Angular access of not less than 45 degrees may be allowed for separately marked entrances and exits. Driveways shall have a width of not less than 16 feet within a distance of 25 feet of the road pavement edge.

Penalties: Any person who violates this Ordinance shall, upon conviction, forfeit not less than $200.00 nor more than $500.00 together with the costs of prosecution.
